Terms of Service

These Terms and Conditions (“Terms”) govern your access to and use of the website, learning platform, courses, applications, simulations, digital learning resources, and related services operated by Third Apple / Third Apple EdTech Solutions (“Third Apple”, “we”, “us”, or “our”), including courses.thirdapple.in (the “Platform”).

By accessing or using the Platform, creating an account, or purchasing a subscription, you agree to be bound by these Terms and by our Privacy Policy. If you use the Platform on behalf of a school or organization, you represent that you are authorized to bind that institution. If you do not agree to these Terms, do not use the Platform.

• Accounts for students may be created by the student, a parent or lawful guardian, or by a school on the student’s behalf. Where the user is a child under the Digital Personal Data Protection Act, 2023, consent of a parent or lawful guardian is required.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must provide accurate registration information and keep it up to date.
• Accounts are personal or school-licensed and may not be shared between individuals.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for educational purposes, in accordance with your subscription or school license.

You agree not to:

• copy, download, redistribute, sell, sublicense, or commercially exploit any content, simulation, worksheet, video, or assessment except as expressly permitted by your license;
• share account credentials or circumvent user limits in a school license;
• scrape, reverse-engineer, or attempt to extract source code, models, or datasets from the Platform;
• interfere with the Platform’s operation, probe vulnerabilities, or bypass authentication or access controls;
• upload unlawful, infringing, or harmful content, or use the Platform to harass any person;
• use the Platform in violation of applicable Indian law.

All content, software, simulations, branding, and materials on the Platform are the intellectual property of Third Apple or its licensors and are protected by applicable IP laws.

• Access may be purchased as an individual subscription or a school-wide / class-wise institutional license, as described on the pricing page.
• Subscription fees are billed in advance through our payment providers (Stripe, Lemon Squeezy, or Polar). Applicable taxes are added at checkout.
• Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date, or unless the school license provides otherwise.
• School licenses are governed by the institutional agreement; in case of conflict, the institutional agreement prevails over these Terms.
• We may change prices with reasonable advance notice; changes apply from the next billing cycle.

• You may cancel an individual subscription at any time from your account or by writing to support@thirdapple.in; access continues until the end of the paid period.
• Refunds for individual subscriptions are governed by our Refund & Cancellation Policy and applicable Indian consumer law.
• School and institutional license cancellations and refunds follow the institutional agreement.

The Platform processes learning progress, activity, and account data as described in our Privacy Policy. We do not sell personal data and do not use student data for advertising. Schools are responsible for obtaining any parental consents required for their students’ use of the Platform.

We work to keep the Platform available and accurate, but we may modify, suspend, or discontinue any part of the Platform (including individual labs, simulations, or content) at any time, with or without notice, provided that material reduction of a paid feature set will be communicated to subscribers. The Platform requires an internet connection and a supported browser; we do not guarantee uninterrupted access on all networks.

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or that results (including academic outcomes) will follow from its use. Educational content is provided for learning support and does not constitute a guarantee of examination results.

To the maximum extent permitted by law, Third Apple shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of (or inability to use) the Platform. Our total aggregate liability for any claim relating to the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or the value of the institutional license for the same period.

We may suspend or terminate your access to the Platform, with notice where practicable, if you materially breach these Terms, misuse the Platform, or fail to pay due fees. You may stop using the Platform and delete your account at any time. Sections that by their nature should survive termination (intellectual property, disclaimers, liability, governing law) shall survive.

These Terms are governed by the laws of India. The courts at Visakhapatnam shall have exclusive jurisdiction, subject to applicable consumer-protection law. Disputes will first be addressed through good-faith negotiation; formal proceedings may be initiated only after 30 days from written notice.

We may update these Terms from time to time. The “Last Updated” date above shows the current version; continued use after an update constitutes acceptance.
